FactorGenie, LLC ("FactorGenie," "we," "us," or "our") operates the website factorgenie.com and related applications (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website or use our Service.

1. Information We Collect

1.1 Information You Provide to Us

We may collect information that you voluntarily provide when you register for an account, use our Service, or contact us, including:

  • Account credentials (username and password)

1.2 Information Collected Automatically

When you access the Service, we may automatically collect certain information, including:

1.3 Data Processed on Behalf of Our Customers

As a service provider to freight factoring companies, FactorGenie may process data that our customers upload or transmit through the Service, such as load documents, bills of lading, rate confirmations, and related freight transaction records. This data is processed solely on behalf of and at the direction of our customers. Our customers are responsible for ensuring that they have the appropriate legal basis for sharing such data with us.

1.4 Financial Account Information

If you use our cash application and reconciliation features, you may choose to connect your business bank account(s) to the Service through Stripe Financial Connections, a service operated by Stripe, Inc. ("Stripe"). Financial account data is collected only after the account owner affirmatively connects an account and provides consent through Stripe's interface, and we request only the read-only data permissions needed to provide our reconciliation services. With your consent, we receive read-only financial account data, which may include account details, account balances, and transaction history (such as incoming deposits and ACH credits). We do not receive or store your bank login credentials — you provide those directly to Stripe or your financial institution. Stripe's collection and use of your data is governed by the Stripe Privacy Policy.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide, maintain, and improve the Service
  • To create and manage your account
  • To process and complete transactions
  • To send you technical notices, updates, security alerts, and support messages
  • To respond to your comments, questions, and requests
  • To monitor and analyze usage trends to improve user experience
  • To detect, investigate, and prevent fraudulent transactions and other illegal activities
  • To comply with legal obligations

We use financial account data (described in Section 1.4) solely to provide back-office cash application and reconciliation services: identifying received payments and matching them to remittance information and open invoice records, and presenting suggested reconciliation results to your operations team. We do not use financial account data to initiate money movement, to make credit or underwriting decisions, or for advertising or marketing purposes, and we do not sell financial account data.

3. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

  • Service Providers: We may share information with third-party vendors who perform services on our behalf, such as hosting, analytics, and customer support. These providers are contractually obligated to use your information only as directed by us. We use Stripe, Inc. to facilitate the collection of financial account data as described in Section 1.4; Stripe's handling of that data is governed by the Stripe Privacy Policy.
  • Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction.
  • Legal Requirements: We may disclose information if required by law, regulation, legal process, or governmental request.
  • Protection of Rights: We may disclose information to protect the rights, property, or safety of FactorGenie, our users, or the public.
  • With Your Consent: We may share information for any other purpose with your consent.

4. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to collect information about your browsing activity. Cookies are small data files stored on your device. We use:

  • Essential Cookies: Required for the Service to function properly (e.g., session management and authentication).

We retain your personal information for as long as your account is active or as needed to provide you with the Service. We may also retain information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we will delete or anonymize it in accordance with our data retention practices.

Depending on your location, you may have certain rights regarding your personal information, including:

  • Financial Account Disconnection and Deletion: You may disconnect a linked financial account at any time by contacting us at support@factorgenie.com or through Stripe; disconnection stops the collection of new financial account data. You may separately request deletion of financial account data we have already collected, and we will delete it unless we have a legal obligation to retain it.

To exercise any of these rights, please contact us using the information provided below. We will respond to your request within a reasonable timeframe and in accordance with applicable law.

8. California Privacy Rights

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect and how it is used, the right to request deletion, and the right to opt out of the sale of personal information.
